Length of Time in Business Waiver Service


If your company does not possess revenues (as proven by federal tax returns) from the most recent 2 years, then it will need to file a Length of Time in Business Waiver Request along with its SBA 8(a) application.

The Length of Time in Business Waiver Request is a substantial multi-page document that must prove to the Small Business Administration that your company possesses the management skills, successful past performance on contracts, credit and capital required to successfully operate your business for the next decade.

To qualify for the 2 year waiver, you must document your ability to meet the following SBA requirements:

Substantial business management experience

Substantial technical experience

Adequate capital to sustain its operations

A record of successful performance on contracts

Demonstrate that you have the ability to obtain new personnel, facilities and equipment

NOTE: If your business has not earned any revenue before, you should wait until you do have several sources of revenue before submitting a 2-year waiver request to the SBA. Companies that have never earned any revenue before will not be granted an 8(a) certification waiver.
